Terms and Conditions of Use — Appigeon

These Terms and Conditions of Use (the "Terms") govern your use of Appigeon (the "App" or the "Service"), the slow-messaging app with virtual pigeons. By using the App you accept these Terms. If you do not accept them, do not use the Service.
The Service may change, be suspended or discontinued, and so may these Terms — in which case we will ask you to accept the new version in order to continue.
1. Who provides the Service
The Service is provided by Luca Trinchero, as the owner of the project (the "Provider").

2. What the Service is
Appigeon is a "slow" messaging app: messages travel on virtual pigeons and delivery time depends on the real geographic distance between users. The Service is for play and entertainment purposes. The game mechanics (pigeons, flights, loans, exchanges, eggs, garrisons and the like) are virtual elements with no monetary value and may be changed, added or removed at any time.
3. Requirements for use
To use the Service you must be at least 14 years old. By registering an account you declare that you meet this age requirement and have the capacity to accept these Terms. If you do not meet the age requirement, do not use the App.
4. Account and registration
- To use the Service you must register an account by providing an email address (verified with a code), along with your first name, last name, username and the location of your "loft". The phone number, verified by SMS, is required only when you activate a paid plan.
- You agree to provide truthful and up-to-date information and not to impersonate other people.
- You are responsible for the confidentiality of your credentials (including your access PIN) and for any activity carried out with your account. Notify us immediately if you suspect unauthorized access.
- A user may hold only one personal account. We reserve the right to refuse, suspend or close accounts created in breach of these Terms.
5. Rules of conduct
When using the Service you agree not to:
- send unlawful, defamatory, obscene, harassing, discriminatory, threatening content, or content that infringes the rights of others;
- harass, threaten, stalk or abuse other users, or send unwanted messages in bulk (spam);
- use the Service for illegal or fraudulent activities, or to violate the privacy of others;
- collect data about other users without their consent, or misuse the information the Service shows you (for example the loft location shared by friends);
- attempt to circumvent security measures, access areas or data not intended for you, or interfere with the operation of the Service;
- decompile, reverse engineer, copy, modify or create derivative works of the App, except as permitted by law;
- use unauthorized bots, scripts or automated systems to interact with the Service, or create fake or multiple accounts.
Breaching these rules may result in the immediate suspension or closure of your account, without prejudice to any other action permitted by law.
6. Your content
- The messages and content you send remain yours. You are solely responsible for what you send and for the consequences of sending it.
- Messages are protected by end-to-end encryption: their content can be read only by you and the recipient. The Provider does not read the content of messages and does not pre-screen it.
- Because the Provider has no access to message content, it cannot moderate messages in advance: responsibility for what you send and receive remains with the users involved. You can block other users and report misconduct using the tools available in the App. When you report a letter, you are the one attaching its text as you see it: it is the only case in which the Provider receives a letter's content, uses it solely to assess the report and keeps it for 180 days, as described in the Privacy Policy.
- You grant the Provider the limited, non-exclusive technical licence necessary to transmit, deliver and store your content solely to operate the Service. The Provider does not use your content for any other purpose, does not sell it and does not use it for advertising.
The processing of your personal data is described in the Privacy Policy, which forms an integral part of your relationship with us.
7. Intellectual property
The App, its software, the name "Appigeon", the trademarks, logos, pigeon illustrations, graphics and any other content created by the Provider are owned by the Provider or its licensors and are protected by intellectual property laws. We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use the App in accordance with these Terms. Nothing in these Terms transfers to you any rights in such content.
8. Plans, purchases and donations
8.1 The three plans
The App is free to use. There are three plans, and what separates them is how much room you have and how much the App helps you find people:
- Free — free of charge, with no expiry. It includes a limited number of aviary slots. It does not include eggs, and it does not let you search for your contacts using your phone's address book.
- Base — paid, annual subscription. More aviary slots, eggs included at a regular cadence, and contact search from your address book.
- Premium+ — paid, annual subscription. Like Base, with more slots, more frequent eggs, and the option to gift Base to a few friends.
The current detail of what each plan includes is shown in the App when you choose, and that is what governs: features may change over time, and changes apply to the period following the one already paid for.
8.2 How purchases work
- Purchases are handled by the store (Apple's App Store or Google Play) under its terms. Prices are those shown by the store at the time of purchase: they may differ between countries and between platforms, even for the same plan, because of the taxes applied.
- Subscriptions renew automatically at the stated price unless cancelled at least 24 hours before the end of the current period. Management, renewal and cancellation happen in your account settings on the store, not in the App.
- Payment is charged by the store when you confirm the purchase, and again at each renewal.
- If we change the price, the new price applies from the following renewal, and the store notifies you under its own rules. You may cancel before it takes effect.
8.3 When a plan ends
On expiry or cancellation you return to the free plan: you do not lose your account, your letters or your pigeons, but the paid plan's features stop being available and the free limits apply again. If you hold more content than the free plan allows, it remains yours and visible, but you may not be able to add more until you are back within the limits.
8.4 Withdrawal and refunds
- Subscriptions are digital content supplied immediately. If you are a consumer in the European Union you generally have a 14-day right of withdrawal; by purchasing and using the plan straight away you request immediate performance and agree to lose that right once performance has taken place, as provided by the rules on digital content.
- In any case, refunds are handled by the store under its policies: they must be requested there. Mandatory consumer rights granted to you by law are unaffected.
8.5 Donations
The App may also offer voluntary donations ("bags of grain") to support the project. Donations are voluntary, grant no gameplay advantage and only add a thank-you badge on your profile. Except where required by law, no refunds are provided by the Provider for donations.
9. No warranty (disclaimer)
Please read this section carefully.
- The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including — by way of example — warranties of fitness for a particular purpose, continuity, freedom from errors or absolute security.
- Like any online service, the App may contain errors, be temporarily or permanently unavailable, suffer interruptions, loss or corruption of data, and game mechanics may change. We do not guarantee the preservation or recoverability of messages, pigeons, statistics or other data.
- Because messages are end-to-end encrypted, if the reading key is lost (for example when you change or lose your device without a valid backup), the message history may not be recoverable by anyone, including the Provider.
- The Provider is not responsible for the content, conduct or damage caused by other users, nor for the relationships you form with them. You decide whom to interact with and what information to share (including the exact location of your loft, which you share only by adding someone as a friend).
- To the maximum extent permitted by law, the Provider is not liable for indirect, incidental or consequential damages, loss of data, profits or opportunities arising from the use of or inability to use the Service. Where liability cannot be excluded, it is limited to the minimum permitted by applicable law.
- Nothing in these Terms excludes or limits the Provider's liability where the law does not allow it (for example wilful misconduct or gross negligence, or the mandatory rights granted to consumers).
10. Suspension and termination
- You may stop using the Service at any time and delete your account from within the App (Settings). Upon deletion, your data is handled as described in the Privacy Policy.
- The Provider may suspend or close your account, in whole or in part, in the event of a breach of these Terms, abusive or unlawful use of the Service, or for technical, security or legal reasons.
- The Provider may also modify, suspend or discontinue the Service, in whole or in part, at any time, as this is an experimental and free project.
11. Changes to the Terms
We may update these Terms. Each new version will be presented to you in the App and must be accepted in order to continue using the Service. Previous versions and the date of your acceptance remain on record. By continuing to use the Service after accepting the new version, you accept the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by Italian law.
For any dispute relating to these Terms or to the use of the Service, the Court of Milan (Italy) shall have exclusive jurisdiction.
Notwithstanding the above, if you use the Service as a consumer, the mandatory jurisdiction of the place of your residence or domicile continues to apply where required by mandatory rules for your protection.
13. Miscellaneous
- If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- The Provider's failure to exercise a right does not constitute a waiver of it.
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Provider regarding the use of the Service.
